Definition of Non-Compliant:
The No Fear Act requires that agencies reimburse the Judgment Fund for personnel discrimination payments made in accordance with 28 U.S.C. §§ 2414, 2517, 2672, 2677 or 31 U.S,C. 1304.
Under 5 CFR Part 724, Congress expects reimbursements to be made within a reasonable amount of time. Upon receipt of a billing letter, an agency has 45 days to either repay the Judgment Fund or contact the Judgment Fund to make arrangements for a payment schedule.
An agency is non-compliant if they fail to reimburse or make timely arrangements for reimbursement. As required by 5 CFR 724.105, the Bureau of the Fiscal Service is posting this annual non-compliance report on the Fiscal Service website.
